Final Means Final

Our client’s former spouse attempted to set aside a mediated marital settlement agreement which had been ratified and made part of a final judgment of dissolution of marriage.  We successfully defeated the former spouse’s baseless attempt to get a second bite at the apple.  We were able to prove that the former spouse did not make a mistake when she entered into the settlement agreement as she had claimed.  Instead, we proved that she knew what she agreeing to when she signed the settlement agreement.  The Court dismissed the former spouse’s petition after she rested her case.

Falsely Accused of Domestic Violence

Our client’s former girlfriend filed a petition for injunction for protection against domestic violence after he sought to establish paternity of their child and a parenting plan.  We successfully opposed the mother’s attempt to limit my client’s ability to spend time with his minor child.  The Court denied the mother’s petition at the conclusion of trial.

$1 Dollar

Our client was sued for six-figures for allegedly breaching an agreement.  We successfully defended our client with the opposing party being awarded just $1 dollar by the jury at the conclusion of trial.  Moreover, the opposing party was held responsible for the payment of our client’s attorney’s fees for unreasonably rejecting our client’s offer of judgment. 

Harmful Horseplaying

Our client sustained significant personal injuries due to rough and boisterous horseplay by others.  We were able to secure substantial compensation for our client.

Move Over

Our clients sustained serious and permanent personal injuries when a commercial landscaping truck veered onto them as they were attending to their disabled vehicle on the side of the road.  We promptly filed a lawsuit and shortly thereafter secured tender of the landscaping company's policy limits along with entry of a consent judgment of a multiple seven-figure sum.

Hazardous Bike Ride

Our client was on a leisure bike ride when he was forced to the ground and sustained a significant shoulder injury as a result of the property owner’s failure to maintain its premises.  We persuaded the opposing side to accept liability and secured proper compensation for our client without having to file a lawsuit.

Wrongful Death

Losing a loved one is never easy but it is even worse when another person or entity is the cause of a loved one’s untimely death.  We secured compensation for close relatives of a loved one that succumbed due to the negligent act of another while operating a motor vehicle. 

Wall Smash

Our client was soundly asleep in her bedroom when a vehicle crashed through her bedroom wall causing her to sustain significant personal injuries.  The at-fault driver failed to carry liability insurance on the leased vehicle.  Notwithstanding, we identified another potential responsible party.  We filed a lawsuit against that party and secured just compensation for our client.

Pro Se Nightmare

Our clients were sued by a pro se former owner of real property for eviction despite our clients having had legally acquired title to the real property from the prior owner before her commencement of the eviction lawsuit.  We successfully defended our clients.  The Court dismissed the eviction action with prejudice after conducting an evidentiary hearing.  The pro se plaintiff then filed a motion for rehearing and a motion for the Judge to recuse herself.  We opposed both motions and they were denied by the Court.

The pro se former real property owner subsequently filed another lawsuit against our clients to quiet title or, alternatively, to partition real property.  We again successfully defended our clients.  We avoided the expense of a trial for our clients by filing a motion for summary judgment which was granted by the Court after conducting a hearing.  The Court entered a Final Judgment in our clients’ favor which removed instruments filed by the pro se plaintiff on several real properties owned by our clients and permanently enjoined her from filing any other instruments against our clients' properties without prior court approval.         

Belly-Up Real Estate Development

We filed a lawsuit to recover deposit monies our client had tendered to a real estate developer who failed to complete the real estate project.  We successfully secured a final judgment in our client’s favor for the monies he was owed.  The final judgment was subsequently satisfied by the developer.   

Gotcha!    

We filed a lawsuit to recover monies owed to our client for services it had rendered to the defendant which wet unpaid.  We secured a final judgment in our client’s favor for the monies owed plus attorney’s fees and costs.  Notwithstanding, the defendant refused to satisfy the money judgment voluntarily.  Accordingly, we located where the defendant had its bank account.  We quickly served the bank with a writ of garnishment and were able to freeze sufficient funds to satisfy the totality of our client’s money judgment. 

Foreclosure

We filed several lawsuits to foreclose purchase-money mortgages given to our client to secure loans to purchase real property.  The foreclosed real properties were either bought by our client via a credit bid or sold to third parties at the online foreclosure auction.

Assisted Living Facilty 

We represented clients that were sued for allegedly causing the wrongful death of a resident at an assisted living facility.  We successfully defensed our clients against this lawsuit. We prepared and filed a motion to dismiss the case.  Shortly thereafter, the Personal Representative of the Estate voluntarily dismissed the lawsuit.
